Dear Prime Minister Chrétien:
We, the undersigned, have followed the situation evolving in the
fisheries since the Supreme Court of Canada rendered its decision in
the Marshall case.
We are very concerned by the attitude and actions of our government in
this matter especially in regard to the Native community of
Esgenoopetitj (Burnt Church). We have seen on the news (August 29,
2000), some appalling actions organized by the Department of Fisheries
and Oceans. These actions are violent and are certainly not conducive
to a peaceful negotiated settlement.
Such settlement will only be achieved if and when your government
acknowledges that Section 35 of the 1982 Canadian Constitution
recognizes aboriginal and treaty rights which include, according to the
Supreme Court of Canada decision in Sparrow, the First Nations of Canada
right to a fishery for food and ceremonial purposes; and according to
the Marshall decision, a treaty right for First Nations in Atlantic
Canada to earn a moderate livelihood from the fishery. Any negotiations
which are not rooted in such a basic acknowledgment are destined to fail.
We urge you, Prime Minister, to get personally involved before it is
too late. Real negotiations between the community of Esgenoopetitj and
the Federal Government should start without any further delay.

Monsieur le Premier ministre,
Les soussignés ont suivi avec beaucoup d'attention l'évolution du
dossier des pêches depuis la décision de la Cour suprême du Canada dans
l'affaire Marshall.
Nous sommes très préoccupés par l'attitude et les actions de votre
gouvernement en ce qui a trait à ce dossier en particulier en ce qui
concerne la communauté de Esgenoopetitj (Burnt Church). Les medias nous
ont montré le 29 août dernier les images des actions déconcertantes
organisées par le ministère des pêches et océans. Ces actions sont
violentes et ne favorisent aucunement une résolution pacifique et
négociée de ce conflit.
Une solution négociée ne sera possible qu'à partir du moment où votre
gouvernement admettra que l'article 35 de la Loi constitutionnelle de
1982 reconnaît aux peuples autochtones du Canada leurs droits ancestraux
ou issus des traités. De l'avis de la Cour suprême du Canada, ces
droits incluent pour toutes les premières nations du Canada le droit à
une pêche pour se nourrir et pour des rituels. Quant aux premières
nations de la région Atlantique, selon la décision Marshall, elles ont
droit de tirer de la pêche une subsistance convenable. Toute
négociation qui ne prend pas pour fondement la reconnaissance de ces
droits est vouée à l'échec.
Nous vous prions, Monsieur le premier ministre, d'intervenir avant
qu'il ne soit trop tard. De vraies négociations entre la communauté d'
Esgenoopetitj et le gouvernement fédéral doivent débuter sans plus tarder.
